E-Discovery Uncovered: What Vendors May Not be Telling You
This session is aimed towards attorneys and in-house professionals who are involved with e-discovery. This interactive discussion will provide real-life examples of "E-discovery Exceptions," files that are not moving through the e-discovery process as you may expect, and learn of their impact on Investigations and Litigation. In non-technical terms we will explain how computers store ESI and thus why these Exceptions exist and how they can be identified. We will discuss the pros/cons of analyzing these files, eliciting audience participation. Case studies impacted by E-discovery Exceptions will also be addressed. Finally, we will provide and review e-discovery protocols that have been implemented since the Dec 2006 Changes to the Federal Rules and discuss what's good, what may be missing and what may be dangerous to counsel, especially in light of these Exceptions.
