The Employee Free Choice Act: Its Origins, Flaws, and Prospects

Over the past three years, organized labor has tirelessly pushed labor reform on Capitol Hill through the Employee Free Choice Act. And, while the bill has yet to pass and Congress continues to consider other legislative priorities, the prospect of labor reform is both real and, as proposed, revolutionary. This presentation will first focus on EFCA as proposed in the Senate in early 2009. While much of the national attention surrounds the so-called "card check" provisions of the bill, other sections regarding first contract arbitration and increased penalties for employers could have more far-reaching consequences than EFCA's election provisions. Next, we will discuss the flaws with the original proposal, including the numerous problems with first contract arbitration, the one-sided nature of increased penalties, and the threat to the employee's right to a private vote. Finally, the presentation attempts to summarize some of the current compromises being discussed in Congress.
