Reinstatement in Bankruptcy Litigation and Negotiation
With corporate bankruptcy filings up 63% so far this year, we can expect related litigation to continue well into the future, and to produce a range of challenges to companies and their attorneys, from credit bidding to reinstatement of debt. Maureen Chakraborty, an economist who works on bankruptcy and other securities-related litigation, along with restructuring and leveraged finance expert Robert Grien, recently analyzed complex refinancing issues in the widely covered Spectrum Brands reorganization case. In this presentation, they will discuss perspectives gained from the issues specific to that litigation, such as debt reinstatement and cram-up, and explore the implications of these and other factors for proposed restructurings.
