Since the US Court of Appeals for the First Circuit upheld a lower court decision allowing the continuation of online lottery ticket sales, determining that these sales do not violate the 1961 Wire Act and setting aside a Department of Justice 2018 Wire Act Opinion that created widespread confusion about the future of online gaming, much speculation has circled around future opportunities for online gaming expansion throughout North America. This decision, coupled with an increase in potential online and sports betting legislation arising out of the ongoing COVID-19 pandemic’s impact on gaming industry revenues and related state taxes, has paved the way for a rapid expansion of all forms of online wagering, creating numerous opportunities for existing and new entrants into the market.
