Emerging Claims and Trends in COVID-19 Litigation

As individuals, companies, and government bodies are quickly responding to the coronavirus pandemic, the legal profession is anticipating a spate of litigation on how the crisis has been handled and its impact on society. With nearly 800 claims filed in less than 2 months, COVID-19 has not only changed how lawyers work but the substantive causes of action they pursue for their clients. DiCello Levitt Gutzler was among those first firms, who filed a lawsuit on behalf of the student body against the Arizona Board of Regents about refunding unused tuition during the campus shutdown this spring. The firm has also filed lawsuits against large insurance companies for allegedly refusing to honor their contractual obligations to policyholders for losses suffered due to COVID-19 related causes.

Join Adam Levitt, the firm’s co-founding partner, and Jennifer Roberts, Product Marketing Manager at Everlaw, as they explore how claims related to the COVID-19 pandemic are impacting the practice of law from practice areas as diverse as personal injury, education and business continuity, to banking, insurance, and even securities law.

Chris Rauen, Sr. Solutions Architect and Caitlin Reinmuth, Product Marketing Manager
Recent global events have forced law firms and their IT teams to accelerate the transition to cloud technologies. The one area that continues to lag behind is ediscovery. Shana Simmons, General Counsel Everlaw and Chris Young, General Counsel Ironclad
The legal industry is rapidly growing, and with it, the roles of general counsels. In today’s climate, they are seen as both strategic business partners and as key members of the leadership team. However, the scope of their responsibilities can get them caught up in the day-to-day and missing the bigger picture.

  • Everlaw Innovates: Uncovering the Needle in the Haystack Recorded: Apr 28 2021 48 mins
Greg McCullough, Fire Litigation Consulting; Veronica Ramallo, Blank Rome LLP; Alex Hafez, Everlaw
Discoverable data volumes are exploding, with projections of reaching 175 zettabytes worldwide by 2025. Without a prescribed map or blueprint leading them to the most critical insights, ediscovery practitioners are challenged with finding the proverbial needle in the haystack amidst this exponential data growth and the introduction of new data types.

Modern search tools and technologies can dramatically improve the document review experience. Panelists Veronica Ramallo, Discovery Attorney at AmLaw 100 firm Blank Rome, and Greg McCullough, Lead Consultant at Fire Litigation Consulting, share their experiences and best practices for document review, including how smart searching, data visualization, and AI have helped them find “hot docs” within mountains of data.

Attendees of this session will receive a complimentary guide on how to construct advanced content searches.
  • Light Up Your Data: How Metadata Can Inform Case Strategy Recorded: Apr 28 2021 75 mins
Alexis Hayman, Everlaw; Steven Scholtz, Everlaw
Understanding metadata and its role in ediscovery is key for attorneys to provide competent representation under the Federal Rules of Civil Procedure and the ABA’s Model Rules of Professional Conduct. Yet, for many attorneys, how content and metadata work together remains a mystery. Without a basic understanding of what electronically stored data is, where it comes from, and how to leverage it during document review, it can be challenging to conduct effective early case assessment or craft an effective review strategy. This has far-reaching implications on meeting case deadlines while controlling costs and ultimately delivering results that satisfy clients and the court.

Join Alexis Hayman, Customer Success Associate, Everlaw; Steven Scholtz, Customer Success Associate, Everlaw, for this session to improve your understanding and create a working knowledge of what ediscovery ingestion is.

Luke Liss, Wilson Sonsini Goodrich & Rosati; Shana Simmons, Everlaw
The path to justice begins with leveling the playing field by increasing its accessibility. ABA Model Rule 6.1 says that “Every lawyer has a professional responsibility to provide legal services to those unable to pay ...and should aspire to render at least (50) hours of pro bono publico legal services per year.” However, attorneys managing complex pro bono matters for underserved clients often find an additional challenge in cost-effectively marshalling ediscovery and related resources in their pursuit of justice. Join Wilson, Sonsini, Goodrich, & Rosati’s Senior Counsel and first Pro Bono Counsel, Luke Liss, and Everlaw General Counsel, Shana Simmons, for a fireside chat to discuss Luke’s path to Pro Bono Counsel and how the Everlaw for Good program helps level the playing field.

    Alex Hafez, Jennifer Roberts
We're replaying our exciting webinar on Storybuilder by Everlaw - now available for free!

Post-review litigation preparation traditionally occurs over email, with competing versions of outlines sent back and forth until no one is sure what’s the most up to date. Digitally preparing for trial often involves a patchwork of solutions, each with a separate cost and the added risk of importing data across different platforms. All this adds up to countless hours lost and spiraling costs that could have been better spent on substantive legal work.

Storybuilder by Everlaw is the first suite of deposition and trial preparation tools of its kind, now available for everyone at no cost. Storybuilder enables legal departments to collaborate securely with colleagues, business partners, inside or outside counsel to craft narratives and efficiently manage the end-to-end process of investigations or litigation. Narrative building ensures alignment among investigative teams by enabling collaborative organization of key documents into a compelling body of evidence. Integrated deposition tracking tools enable significant cost reductions and time savings by eliminating the need to print out physical copies of all exhibits, pass handwritten notes, and later transfer key information into an online repository.

In a first for the legal industry, sign ups are now free for the Storybuilder by Everlaw platform.

Join Alex Hafez and Jennifer Roberts for an overview of how Storybuilder streamlines litigation preparation and sets the stage for critical internal and external collaboration.

  • Disruption as an Enabler for Change: Transforming Ediscovery in the Cloud Recorded: Nov 25 2020 61 mins
Caitlin Reinmuth, Product Marketing Manager; Gregory Campbell, Senior Solutions Architect
Technology modernisation in the legal world has evolved from upgrading operating systems and adopting modern word processors, to moving critical workflows like ediscovery to the cloud. However, according to the 2019 ILTA Technology Survey, only 33% of law firms had a cloud-based ediscovery solution, with 15% looking to move to the cloud in the next 12 months. Recent global events like the coronavirus pandemic are forcing legal teams to accelerate the transition to modern, cloud-based ediscovery platforms for their remote teams.

Join Everlaw's Caitlin Reinmuth, Product Marketing Manager, and Gregory Campbell, Senior Solutions Architect, as they discuss how firms can transition to the cloud — piecemeal or entirely — to leverage the benefits of:

    - Empowering remote teams to collaborate on any stage, from anywhere
    - Scaling workflows based on caseloads, seamlessly
    - Recovering costs at different stages of ediscovery
    - Relying on enterprise-grade security for data protection and privacy
  • Transitioning Federal Agencies to the Cloud: Innovation in Procurement Recorded: Oct 28 2020 30 mins
Angela Kovach, Senior Federal Solutions Architect; Caitlin Reinmuth, Product Marketing Manager
One of the fastest routes to IT modernization lies in the adoption of cloud computing technology. By leveraging cloud technology, Federal agencies can rapidly implement new technologies while also saving costs that used to be allocated to data center maintenance. But perhaps most importantly, cloud technology empowers federal employees to access mission critical resources from wherever they may be working. Everlaw is a cloud-native ediscovery solution, optimized for self-service and instant deployment. Already equipped to support the federal government’s IT transformation, Everlaw expedites procurement for quicker access to an integrated, modern ediscovery solution.

Technology modernization discussions are usually focused on the technology itself, but we think innovation can extend beyond products into federal processes. Join us as we explore ways that agencies can leverage technology and disruptive thinking to shake up the procurement process and discover fresh solutions to evergreen challenges. In this webinar we will discuss:

    - Taking advantage of agency “Wish Lists” (they’re not just for Santa)
    - Making the right “match” - what to look for in vendors during procurement planning
    - Fast tracking technology acquisitions with the FAR
    - Thinking outside the procurement box - how “Pitch Days” are helping agencies find innovative new solutions
  • Accelerating trends: Transforming efficiency in legal teams post covid-19 Recorded: Oct 20 2020 59 mins
    Shana Simmons, General Counsel
The covid-19 pandemic has led to a rapid transformation in the legal industry. General counsels have had to swiftly implement remote collaboration tools, develop in-house resources, and rapidly adapt business strategies, all under budgetary pressures.

Remote collaboration tools have been essential to dealing with customers, workforce, suppliers and other stakeholders in the legal ecosystem. Seeking a balance between in-house and outsourced counsel while optimising productivity is one of the primary challenges. Teams are having to revisit their operational strategy to do more with less, without compromising on the client experience.

This Insight Hour will explore the recent trends for legal teams and how they are driving efficiencies to increase productivity and profitability.
Among the key questions we will explore are:

    - Which trends have seen a pandemic driven acceleration and which will last even after the pandemic?
    - To what extent has technology been a key driver of efficiency?
    - Is it more efficient to invest in-house or to use outside counsel? How do you balance the two to optimise productivity?
    - Is covid-19 transforming D&I in the workplace, and if so, how?
