In this informal panel discussion, recorded on 24 September 2020, experts from the UK, Germany, France and the Netherlands discuss the European Court of Justice decision in the case of Schrems II handed down in July, and its impact on workplace data transfers. The Court ruled the EU-US Privacy Shield invalid, and although model clauses can still be used for cross-border data transfers, the level of data protection must be equivalent in the receiving country to that provided in the EU. The panelists tackle the following:
Do we wait for new solution ('Safe Shield' or 'Privacy Harbour'?) to emerge from the wreckage of Privacy Shield?
Do we all scramble to implement Standard Contractual Clauses (SCCs)? If so how do we comply with the Court's recommendations regarding due diligence on importer countries?
Are other options available? Can we really use the exceptional derogations provided by Article 49 in anything other than an ad hoc and occasional way?
Are regulators going to grant grace periods or are they sharpening their sanction tools in readiness for a series of extra-EEA (and UK) transfer related fines in Q3 and Q4?

EU Member States had until 30 July to comply with the revised rules on posted workers. Those new rules expand existing European legislation requiring workers who are temporarily seconded to a EU Member State to benefit from conditions more like those of local workers in the host country. But, as is often the case in the EU, each Member State has its own variations - and some countries have so far failed to implement the new rules at all. So what does all this mean for international employers wanting to second employees abroad? We find out in this very focussed and practical webinar, involving lawyers from a range of EU countries.

Coronavirus is throwing many new and unexpected challenges at employers. For example, within the EU, in which all countries are subject to the General Data Protection Regulation (GDPR), there are differences of opinion as to how to balance the right to individual privacy against the health of the community. Some governments are actively exploring the use of tracking apps, whereas others are holding back. Meanwhile, employers are starting to ask about the extent to which they can measure and monitor the health of their employees. We hope you will join us to explore these and other fascinating issues.
