The EU Omnibus Package – A Game Changer or a Setback for Sustainable Finance?

The EU’s Action Plan on Digitising the Energy System has marked a bold move to bridge digital innovation and sustainability. The Hidden Risks of Rare Metals in the Energy Transition

Across the global sustainable finance landscape, labelled bonds provide an important mechanism for financing the growth of a ‘green economy’ and help investors align their portfolios with sustainability goals globally.
Green, Social, and Sustainable Bonds’ outstanding level has grown to over 100 times the size it was 10 years ago and has surpassed $ 4 trillion in 2024. But as the volumes of Labelled Bonds continue to grow, so is the debate about the drivers behind the demand for their issuance, and the existence of premium for the label (so-called “Greenium”).
The process for issuing Labelled Bonds tends to be rather complex – as they need to demonstrate their “green” (or other labels) credentials; impact; include rigorous reporting; and second-party opinions. So can Issuers pass on these additional costs?

Labelled Bonds - Greenium - fact or fiction?

An upswing of data that suggests that there is a relationship between the financial performance of a portfolio and sustainability led to increased interest of investors in ESG funds. As the evidence compiled, there has been more and more pressure put on companies to disclose what are their risks and opportunities related to ESG. The concerted effort of policymakers, standards setters, and regulators helps to increase standardisation – but can an ESG Fund that uses standardised data outperform? Theoretically, standardised data should be already priced in. And what exactly do we mean, when we say an “ESG Fund” when discussing if it outperforms (or underperforms)? And does an improvement in the ESG fund’s performance reflect an improvement in the environmental factors in the real economy, considering that climate metrics can be influenced not only by the actual emissions of companies in the portfolio, but by portfolio managers’ decisions, and other financial variables? Changes to the weight in the portfolio or companies’ enterprise values will impact a climate-related investment strategy but may do little to reduction of emissions in the real economy. The result can be similar in the implementation of a divestment strategy.

Physical Climate Risk to Corporate Assets and Investment Portfolios

Investors have become increasingly concerned about the risks of companies with poor ESG performance. Such companies could become very hard to sell and adversely affect the financial performance of a portfolio. Competitive positioning and public perceptions may be affected along the way. Wouldn't therefore be useful to have a database of companies that have been excluded by Pension Funds, Asset Managers, Insurance companies and Banks? It would provide not only much-needed transparency but could also put additional pressure on those identified companies to change their practices.
A new website launched last month by a coalition of NGOs provides exactly that – a list of companies that are blacklisted by investors. It also includes a classification of reasons for the exclusions.
To date, the tracker lists a total of 4532 companies that have been excluded by 87 Financial Institutions in 16 countries. The most common reason for exclusion is Climate/fossil fuels, followed by controversial weapons, and tobacco.

Financial Exclusions Tracker

Launched in 2019, the UK’s Green Finance Strategy aims to establish the UK as a centre for international green finance and to align the financial sector and capital flows with the delivery of global and domestic climate and environmental objectives. The implementation of Sustainability Disclosure Requirements (SDR) forms a major part of the strategy and aims at addressing the information gap for market participants, ensuring a flow of decision-useful sustainability information, and improving transparency. Market participants, however, have been waiting for the publication of the sustainability disclosure rules by the Financial Conduct Authority (FCA), who postponed it twice, likely due to the volume and complexity of consultation feedback and potentially “suboptimal” interrelationship with other regimes – eg. European and US regulations.

Latest on the UK's Sustainability Regulations

Even though it feels that Governance was with us “forever”, until 2021 there was no international benchmark for good corporate governance. Earlier this year (on 28th June), we discussed with Carolynn Chalmers – co-editor of ISO 37000 and the CEO of the Good Governance Academy – the principles of ISO37000 on Governance; how ISO37000 addresses Sustainability and Double Materiality; the role of data in governance; and went into greater detail of ISO37000 and why it matters to leaders.

This is however a dynamic space and at the G20 Summit on 9-10 September, G20 and OECD launched the revised Corporate Governance Principles, which in the words of the OECD Secretary General “mark a significant, renewed international consensus and strong desire from all OECD and G20 Members to strengthen guidance on companies’ sustainability and resilience, to help them support the green transition and adapt to climate risks”. 
Vice-Minister of Finance for International Affairs who chaired the revision added that “The Principles aim to help companies access financing from capital markets, protect investors, and make companies, and hence economies, more resilient.

Spotlight on Governance in ESG – G20/OECD Principles

“Why are we wasting most of the energy and food in the world?”
Why can’t renewables and vegetables save the world?
Why is what we are doing making things worse?"
These are just a few questions asked by Jonathan Maxwell in his recently published book “The Edge”. Many people now know that seven of nine planetary boundaries have been surpassed by humans. In this urgent situation, businesses and governments have been committing to Net Zero, yet few had a chance to map out exactly what such commitments mean in practice. In the meantime, about 70% of the world’s energy, 50% of food, and 30% of water are being wasted in the “cradle-to-grave cycles”. 
We need many solutions to get to Net Zero, but how do you set priorities to ensure that we get there “in time”? And how do you direct your investment? 
“The Edge” seeks to establish a framework to explain what is happening in the world today. And the author, Jonathan Maxwell, will share with us what he has learnt about the mindsets of government, big business and finance at times when the realisation of what it means to get to Net Zero puts a rift in the consensus of how to get there. 
Jonathan, who trained at Oxford University as a modern historian and has become a professional investor, put everything on the line to follow his conviction. Spotlight on “Governance” in ESG

Biodiversity loss was one of the top three risks identified in the World Economic Forum’s 2022 Global Risk Report. The risks are getting the attention of regulators, policymakers, and public and private market participants, however, biodiversity risk incidents are still rising and not many companies have actually undertaken materiality assessments on environmental risks beyond climate change. Even though already 6 years ago, the world’s most significant forums for the promotion of biodiversity conservation concluded that “current public funding was far less than that required to support effective conservation action globally. [And...] enhanced private-sector engagement was desperately needed” (*), the progress on biodiversity finance appear to be still elusive. “Like the financial crisis, the tragedy on the horizon represents a crisis of valuation and values.”(**) The list of challenges to account for biodiversity in business models appear to be long, in the meantime "it is only once the rainforest is cleared and a cattle herd or soya plantation is placed on the newly opened land that the Amazon region begins to have market value. The cost to the climate and biodiversity of destroying rainforest appear on no ledger”. (**)

Biodiversity loss – do we have the right business models to prevent it?

The energy sector has seen landmark write-downs: – Royal Dutch Shell - $22Billion; Total - $8billion; Eni - €3.5 billion – and these are statistics taken before we’ve heard the landmark case of a court in the Netherlands requiring an Oil major to align its policies with the Paris Climate Agreement. 
In 2020, investors had increased their ESG investment significantly or moderately, with negative screening/exclusions remaining one of the most common strategies of ESG integration.
