The settlement discipline regime of the European Union’s Central Securities Depositories Regulation (CSDR) is scheduled to apply from 1 February 2021. Firms are entering the final lap of their preparations and testing, but several hurdles and unknowns stand in their way. Efforts are underway to resolve or work around issues including finding buy-in agents, treatment of ETFs, apparent asymmetry for buy-in compensation, buy-in reporting, new issuance, contractual settlement, and the receiving party’s requirement to put a settlement on hold.
